Our relationships are built on the foundation of trust and as such we care about the privacy and security of your Personal Information. This document details how we collect, use, and share your Personal Information. It also explains what your rights are in terms of the Protection of Personal Information Act of 2013 (“POPIA”).

How we collect your Personal Information

  • We obtain your Personal Information when you provide it to us (e.g., where you contact us via email or via the internet or by telephone, or by any other means, such as providing us with your Personal Information verbally or by business cards or providing us with any due diligence documentation as part of our regulatory requirements).
  • We collect your Personal Information in the ordinary course of our relationship with you (e.g., gathering of information for your financial planning, completing of application forms and interactions during reviews and consultations) and pursuant to our agreement.
  • We may receive your Personal Information from third parties who provide it to us (e.g., your employer; accountant; lawyer and insurance broker) where you have authorised this or the nature of our relationship with the third party permits this to be provided to us.

What Personal Information we collect

  • Personal Information such as your name and surname or the name of your legal entity, ID or registration number, contact details, tax registration numbers and marital status.
  • Family information such as the names, contact details and dates of birth of your spouse, children and family.
  • Name, surname, ID number and contact details of any individuals connected to a legal entity.
  • Financial information such as your banking details, transaction history, income and expenses, assets and liabilities, investments and insurance policies.
  • Medical information as disclosed on medical aid, GAP and insurance applications and which you share with us to process claims on your behalf.
  • Education and employment information.
  • Other information you choose to share with us in the course of our relationship.

Why we collect your Personal Information

  • To provide you with financial advice, planning and related services.
  • To process applications and provide ongoing services on your investment, medical aid, GAP cover and insurance contracts as your intermediary.
  • To comply with our legal and regulatory obligations under various pieces of legislation like the Financial Intelligence Centre Act, 38 of 2001 and the Financial Advisory and Intermediary Services act, 37 of 2002.
  • where you have provided your consent for marketing purposes.

Who we share your Personal Information with

We may need to share your information with third parties that provide products or services that we use or that you have requested. These third parties may include:

  • your family, associates and representatives, employer, and third-party service providers, who you have authorised us to provide information to;
  • product providers such as investment, insurance and medical aid companies;
  • accountants, auditors, lawyers and other professional advisors to us, subject to contractual obligations of confidentiality;
  • Information Technology specialists assisting us with data storage, security, processing, analytics, etc;
  • third party processors (such as payment services providers; courier companies; etc.);
  • regulatory or governmental authorities such as the Financial Sector Conduct Authority and the South African Revenue Service.

Where we share your information with third parties we have contracted with, including parties outside of South Africa, we will take the necessary precautions to ensure that the third party will treat your information with the same level of protection as we are obliged to.

How your Personal Information is stored

  • As far as possible, Personal Information will be stored in electronic format on servers that are protected by appropriate access control and security measures.
  • Physical records will be converted to electronic format as soon as reasonably possible and subsequently securely destroyed.
  • Physical records that need to be maintained (such as wills and legacy documents) will be stored in a secure off-site location.

How long do we keep your Personal Information

Under South African law, we are required to keep your Personal Information for a five (5) year period following the date of termination of the business relationship.

After this period, your Personal Information will be either:

  • permanently deleted or destroyed; or
  • archived so that it is secure and beyond use, save in highly controlled circumstances.

What your rights are

  • Should you believe that any of your Personal Information held by us is incorrect or incomplete, you have the right to request to view this information, rectify it or have it deleted. Please contact our Information Officer on the contact details provided.
  • In addition, if you wish to complain about how we handled your Personal Information, please contact our Information Officer on the contact details provided. Our Compliance Department will investigate your complaint and contact you within two (2) business days of the complaint being lodged and work with you to resolve the matter.
  • If your query relating to your Personal Information is not, in your opinion, adequately dealt with, you can contact the Information Regulator on 012 406 4818 or inforeg@justice.gov.za to file an official complaint.
